Classifications of Gaming in Malta
The Malta Gaming Authority (MGA) categorizes gaming into several types for both B2C and B2B licenses:
- Type 1: Games of chance, such as Roulette, Poker, Lotteries, and Blackjack, where players compete against the establishment in random outcomes.
- Type 2: Games of chance dependent on external events or games of luck.
- Type 3: Player vs. player games, like Poker and Tombola, where the operator earns risk-free commissions.
- Type 4: Controlled skill games, as defined in the Gaming Authorisations Regulations – Part 8.
Entities offering services or targeting local customers must secure MGA authorization. Those providing various game types receive a designation that reflects their primary game, which often requires more substantial capital.
Different gaming verticals, including online casinos, lotteries, betting, and more, require separate approvals. Each approval comes with unique safeguards to comply with regulations and promote responsible gaming, evaluated through the MGA’s LRMS.
Group LIcensing
Regarding Group Licensing, corporations can apply for either individual or corporate group licenses. Within a group, license transfer is possible with MGA approval.
In terms of exemptions, skill games without stakes or prizes are free from licensing. However, skill games with stakes and prizes are regulated and monitored. Material Gaming Supplies, vital to the industry, need strict control to prevent operational disruptions. Additionally, games with stakes under 5 Euros or promotional games with prizes up to 50,000 Euros are classified as Low-Risk Games.
Operators with games licensed in other EU/EEA states can obtain a Recognition Notice from the MGA, equivalent to local licensing.
